Criminal Procedures: New Rules for Sentencing
|
Abstract: In two recent landmark decisions, the Supreme Court upended two decades of sentencing law and procedure in the United States and fostered substantial uncertainty among the bench, prosecutors and criminal defense practitioners. The Court's decisions in United States v. Booker and United States v. FanFan held that the United States Sentencing Guidelines were no longer binding on the federal courts, but they should be considered advisory by sentencing judges. Although the decisions end a decades-long dispute about the validity of the USSG, they have also spawned a host of questions about their application prospectively - and possibly retroactively. This TeleSeminar will feature U.S. District Court Judge Paul Cassell (D. Utah), the first federal judge writing an opinion holding the USSG unconstitutional and the first judge to issue a decision interpreting Booker. Judge Cassell will be joined by Douglas Berman and Orin Kerr, leading authorities in their own right on sentencing policy in the United States. (telephone seminar)

Malpractice Claims Against Expert Witnesses

Abstract: Expert witness testimony - scientific, medical, and professional - is crucial to most litigation. Substantial resources are devoted to identifying expert witnesses and preparing them for trial. The credibility of their testimony often determines the outcome of the trial. Without an effective expert witness a plaintiff's claim is unlikely to prevail and a defendant risks liability. But what if the expert testifies falsely? Or negligently? Or not consistent with professional standards? If so, is the expert liable to the hiring party, to the non-hiring party, or even to third parties? Does the expert have immunity? All of these issues and more are deeply uncertain but becoming the focus of increasing litigation and judicial attention. Read Advocacy Material: President Bush Signs Second Chance Bill
 President George W. Bush today signed into law the Second Chance Act of 2007 – legislation inspired by his 2004 State of the Union address – which authorizes $362 million to expand assistance for people currently incarcerated, those returning to their communities after incarceration, and children with parents in prison. It quickly gained broad bipartisan support and earned the backing of law enforcement, state and local government, religious and justice reform organizations. The Second Chance Act was first introduced in 2004, by then-Representative Rob Portman (R-OH) and Senator Sam Brownback (R-KS), to help the nearly 700,000 people leaving prison each year.

Read Publication: Disparity By Geography: The War on Drugs in America's Cities
Documents the growth in drug arrests at the city-level between 1980 and 2003 and the role of the "war on drugs" in expanding racial disparity in the criminal justice system. The extreme variations in arrest rates among cities raise critical questions about the effect of local policy decisions, not overall drug use rates, in driving law enforcement patterns.

Read Feature: Lawrence and Lamont Garrison
Identical twins Lawrence and Lamont Garrison were inseparable. In elementary school, one would rush to the other’s classroom and wait until he was dismissed. Living in the same house in Washington, D.C. that their mother and grandmother had grown up in, they attended Howard University together. Both worked part time to help pay their tuition – Lamont for the Department of Justice and Lawrence for the Department of Energy. Good students and aspiring lawyers, the twins graduated together in May 1998.
